General Terms and Conditions (GTC)
Holiday Apartments Casa Martini in Vairano (Gambarogno), Switzerland
1. Scope

These General Terms and Conditions (GTC) apply to all bookings and stays at the Casa Martini holiday apartments located in Vairano, Gambarogno, Switzerland.
By making a booking, the guest accepts these GTC.

2. Conclusion of Contract

The rental agreement is concluded as soon as:

the guest makes a booking (e.g. via Airbnb, Booking.com, or directly), and
the landlord confirms the booking.

The person making the booking is considered the contracting party and is liable for all accompanying guests.

3. Prices and Payment Terms
All prices are stated in Swiss Francs (CHF), unless otherwise specified.
The price includes use of the apartment, furnishings, and utilities (water, electricity), unless stated otherwise.
Additional costs (e.g. final cleaning, tourist tax) are detailed in the invoice.

Payment terms:

For direct bookings:
Deposit of 50% within 5 days after booking
Remaining balance no later than 14 days before arrival
Short-term bookings: full amount due immediately
4. Tourist Tax

The legally required tourist tax of the municipality of Gambarogno is charged per person per night and is detailed in the invoice.

5. Arrival and Departure
Check-in: from 4:00 PM
Check-out: until 10:00 AM

Different times are only possible upon prior agreement.

6. Use of the Holiday Apartment
The apartment may only be used by the number of persons specified in the booking.
Subletting or transfer to third parties is not permitted.
Parties or events are not allowed.
The house rules form an integral part of these GTC and must be observed.
7. Duty of Care

The guest undertakes to:

treat the apartment and its furnishings with care
report any damage immediately

The guest is liable for any damage caused beyond normal wear and tear.

8. Pets

Pets are only allowed if explicitly confirmed in advance.

9. Cancellation Policy (Direct Booking)
Up to 30 days before arrival: free cancellation
29–14 days: 50% of the total price
Less than 14 days: 100% of the total price

For bookings made through platforms, their respective cancellation policies apply.

10. Withdrawal by the Landlord

The landlord may withdraw from the contract if:

force majeure occurs
the accommodation becomes uninhabitable
the guest violates the GTC

Payments already made will be fully refunded in such cases. Further claims are excluded.

11. Liability
The landlord is only liable for intentional or grossly negligent conduct.
No liability is accepted for the guest’s personal belongings.
Use of facilities such as the jacuzzi, sauna, or outdoor kitchen is at the guest’s own risk.
12. Internet Use (Wi-Fi)

The guest agrees not to use the Wi-Fi for illegal activities.
The landlord accepts no liability for misuse.

13. Quiet Hours

Statutory quiet hours (in particular night-time rest from 10:00 PM) must be observed.

14. Data Protection

Personal data is used exclusively for processing the booking and will not be passed on to third parties unless there is a legal obligation to do so.

15. Jurisdiction and Applicable Law

Swiss law applies.
The place of jurisdiction is the landlord’s place of residence or the competent courts of the Canton of Ticino.

16. Severability Clause

Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
